Milbank Attorneys Assess Biden Administration’s Proposed Greenhouse Gas Emission Standards in The Journal of Federal Agency Action

Milbank LLP Global Project, Energy and Infrastructure Finance partner Allan Marks and head of the firm’s Environmental Practice Area Matthew Ahrens, along with Environmental special counsel Thomas D. Goslin and Environmental associate Allison Sloto, co-authored an article in The Journal of Federal Agency Action titled “Proposed Environmental Protection Agency Carbon Pollution Standards Would Impact Energy Sector.”

The article assesses the Biden administration’s proposed greenhouse gas (GHG) emission standards for new and existing fossil fuel–burning power plants, which aim to reduce total carbon dioxide emissions by 617 million metric tons by 2042. The proposed rule would impose new source performance standards (NSPS) for GHG emissions from new fossil fuel–fired stationary combustion turbine electric-generating units (EGUs), and establish new emission guidelines for large, frequently used existing stationary combustion engines and existing steam-generating EGUs.
