Milbank LLP Global Project, Energy and Infrastructure Finance partner Allan Marks was interviewed on Inframation’s “Crossroads: The Infrastructure Podcast” about the US energy market, the implications for investors of the Supreme Court’s West Virginia v. Environmental Protection Agency decision and possible future federal rules on power plant emissions. He also looked at the implications of the breakdown in Congressional negotiations surrounding the Build Back Better climate package.
Mr. Marks discussed how the combination of lower natural gas prices, federal tax credits, and state-level climate and energy regulation has encouraged renewable power (mainly solar and wind energy), despite broader political and regulatory uncertainty at the federal level. He also analyzed the intersection of regulation and private investment decisions, including how tax credits and other programs can incentivize new investments in transmission, solar power, onshore and offshore wind energy, and newer technologies like green hydrogen, carbon capture and energy storage.
