Dustin Stark is special counsel in the New York office of Milbank LLP and a member of the firm’s Executive Compensation and Employee Benefits Group focusing on labor and employment matters.

Primary Focus & Experience
Mr. Stark’s practice focuses on advising on the full range of labor and employment issues in all aspects of complex corporate transactions, bankruptcies, and restructuring engagements. He counsels employers, creditors, funds, and sponsors on issues involving the acquisition and organization of workforces, including evaluation of employment risks and obligations, the transfer, hiring and firing of workers, unionization and labor-management relations, and negotiation of collective bargaining agreements.
Mr. Stark regularly advises clients on the design, implementation, and enforcement of restrictive covenant agreements, including non-competition, non-solicitation, and confidentiality provisions. He also counsels and defends employers in an array of labor and employment disputes and litigation, and handles matters involving claims of employment discrimination and retaliation, whistleblower claims, wage and hour compliance, performance management, workforce reductions, employment contract negotiations, and complex HR investigations.
Mr. Stark also has substantial experience in National Labor Relations Board proceedings, including advising and representing employers in union representation and unfair labor practice proceedings, collective bargaining, and arbitrations. He counsels clients on compliance with traditional labor laws, responding to union organization efforts and managing labor-management disputes.
