Andrew S. Wellin (“Drew”) is special counsel in the New York office of Milbank LLP and a member of the firm’s Litigation & Arbitration group. He is a senior antitrust attorney with a wealth of experience in transactional matters, antitrust litigation, and investigations and counseling. He advises public and privately held clients on mergers and acquisitions, joint ventures, intellectual property licensing transactions, and investigations before the US Federal Trade Commission, the US Department of Justice, and international competition agencies. Drew has advised clients on over 100 transactions in a broad range of industries including pharmaceuticals, energy, technology, industrials, retail/e-commerce, and financial services. He is regularly involved in high stakes antitrust litigation where he has successfully defended clients in some of this decade’s largest complex class actions as well as single-plaintiff cases involving price fixing, market allocation, group boycotts, various restraints of trade, monopolization, and other violations of federal and state antitrust and consumer protection laws.

Primary Focus & Experience

Drew has particular expertise in antitrust issues in the pharmaceutical industry. In addition to litigated matters, he has served as antitrust counsel on dozens of developmental licensing and collaboration deals. He also regularly advises clients on Hatch-Waxman Act and Biologic Price Competition and Innovation Act settlements to achieve commercial resolutions while mitigating antitrust risk.

Recognition & Accomplishments

Drew received his J.D., cum laude, from Brooklyn Law School and his B.A. from Colorado College. While at Brooklyn Law, he was inducted into the national Order of Barristers for outstanding oral advocacy.
