Milbank Obtains Successful Decisions on Behalf of Fujitsu in Inter Partes Reviews Before the US Patent & Trademark Office

Representing Fujitsu Network Communications, Inc. (“FNC”) in a patent infringement lawsuit filed in 2014 and in proceedings before the US Patent & Trademark Office (“PTO”), a Milbank IP Litigation team prevailed in inter partes review proceedings on September 28, 2016. The PTO decisions ordered that all challenged claims in two patents asserted by Capella Photonics, Inc. are unpatentable.

Milbank filed two petitions for inter partes review challenging the patentability of the asserted claims of the Capella patents. The PTO instituted FNC’s inter partes review proceedings in 2015 on the two Capella patents and held oral argument in May 2016.
