Financial Restructuring partners Abhilash Raval and Lauren Doyle, along with of counsel Dennis O’Donnell, recently co-authored an article titled “Cross-border restructuring in the US: Chapter 15 approval of third-party releases granted in foreign proceedings” for the 2019/20 edition of the International Insolvency & Restructuring Report.
The article discusses non-consensual third-party releases, which are an often-sought form of relief pursued in connection with restructurings under US laws and oftentimes a source of controversy regardless of the jurisdiction where they are sought.
