Milbank International Arbitration Partner Viren Mascarenhas Quoted in Climatewire

Milbank LLP International Arbitration partner Viren Mascarenhas was quoted by Climatewire in the article, “Climate Action Shifts to the Courts as Lawsuits Proliferate Worldwide.” The article discusses the rise of climate lawsuits against governments, fossil fuel companies and other actors.

Mr. Mascarenhas said he expects a “bit of reckoning” for companies if courts begin to deliberate new curbs on emissions or call on governments to impose more stringent regulations. “They’re very focused on what these lawsuits could mean for historic, past activity and the future of what they will need to do,” he said.

Mr. Mascarenhas has significant experience advising or representing states, international organizations and companies in proceedings before international courts and arbitral tribunals, including on international investment law, international environmental law, transboundary harm and human rights. Milbank recently represented the UN Special Rapporteurs for Human Rights & Climate Change (Dr. Ian Fry), Toxics & Human Rights (Dr. Marcos Orellana), and Human Rights & the Environment (Dr. David Boyd) in a submission to the International Tribunal for the Law of the Sea regarding the rights and human obligations of States under the United Nations Convention on the Law of the Sea regarding climate change.
