Milbank LLP Project, Energy & Infrastructure Finance partner John Dewar has acted as the Contributing Editor to Getting The Deal Through’s Electricity Regulation 2024 guide and co-author for the UK chapter with special counsel Seyda Duman.
Within the new edition of this guide, Mr. Dewar and Ms. Duman discuss government policies and the legislative framework for the electricity sector, the authorisations that underpin the operation of distribution networks, interconnectors, generation facilities, and transmission networks, and public service obligations. They also discuss emerging trends and hot topics in the landscape of UK electricity regulation, noting, “At the height of the pandemic, lockdowns precipitated a unique and sustained drop in energy demand (including electricity) … Changes in work- and home-life patterns resulted in variations of peak usage times and both residential and commercial demand curves. The International Energy Agency estimated that weekly electricity demand decreased 10 to 35 per cent across affected regions. However, this has changed markedly since restrictions have been lifted, and demand has increased significantly. This, combined with volatile energy markets arising from the impact of the war in Ukraine, has necessitated an urgent regulatory response.”
The guide offers critical insights into various aspects of the local legal framework and covers a comprehensive spectrum, including the regulation of power generation, grid connection, and alternative energy sources. It also encompasses key aspects such as climate change policy, energy storage, nuclear power, transmission and distribution, as well as the sale of power, including both retail and wholesale pricing and public service obligations. Additionally, the guide delves into the regulatory authorities overseeing these domains and explores competition regulation, including merger control. For a global perspective, it includes cross-border considerations, spanning mergers and acquisitions, as well as interconnection regulations.
