Litigation partner Michael Nolan moderated a panel at the Juris Conferences’ 10th Annual Investment Treaty Arbitration Conference in Washington, DC, on May 13, 2016. The panel’s topic was “10 years of abusive round pegs in square holes or a system already moving in the right direction?,” in which panel members discussed how the definitions of “investor” and “investment” have created a debate about the proper scope of investment arbitration. The two-day conference involved a group of 10 authors taking contrary positions while discussing the dramatic developments of investment arbitration over the past 10 years.
