On April 6, Milbank's head of US antitrust, Fiona Schaeffer, moderated a panel discussion among the four Deputy Assistant Attorneys' General at the Antitrust Division who oversee criminal and civil antitrust enforcement and merger reviews at he US Department of Justice. Ms. Schaeffer is the Vice Chair of the ABA's Antitrust Law Section and will become the Section's Chair in August, 2023.
The session featured insights from the Antitrust Division's leadership on recent changes in the criminal leniency program, prospective changes in the merger guidelines and the Antitrust Division's enforcement priorities. The speakers emphasized that the Antitrust Division intends to challenge more mergers in court rather than accepting negotiated remedies, is preparing to bring more monopolization cases, including potentially on a criminal basis, and is expanding its labor market enforcement efforts to include investigating and potentially challenging wage and salary information exchanges among employers, while continuing to prosecute "no poach" and wage fixing cases.
