The section highlights ongoing issues that shape patent law in the United States. Specifically, this section addresses a “battle” of sorts that has developed between the United States Patent and Trademark Office (the “PTO”) and the Federal Circuit, and how this battle has been highlighted by two of the biggest issues in patent law this year: (i) the authority of the PTO; and (ii) how to properly define the scope of patent eligible subject matter.
