Milbank Files Amicus Brief on Behalf of K-12 Educators in Fisher II

Milbank filed an amicus brief in the US Supreme Court in support of The University of Texas at Austin, which considers a student’s race in its holistic admissions process. The brief is on behalf of a coalition of educators, educational institutions and grant programs that includes Teach for America, the Metropolitan Council for Educational Opportunity and the Calhoun School. Eliminating race from the admissions process, the coalition argues, would diminish the quality of K-12 education for all students, promulgate stereotypes that certain minority groups are inferior and decrease diversity in the K-12 teaching force.

The Supreme Court is considering the place of race in admissions policies for the second time in Fisher v. University of Texas at Austin, an action brought by Abigail Fisher, a Caucasian student who was denied admission under the University of Texas at Austin’s holistic admissions policy. The Supreme Court’s second look at this case comes after the 5th US Circuit Court of Appeals affirmed, for the second time, the District Court’s ruling in favor of UT Austin’s admissions policy.

The amicus brief was prepared by Litigation associates Patricia Astorga, Christopher Almon and Christopher deLaubenfels, with supervision by Litigation partner Errol Taylor. Oral argument is scheduled for December 9, 2015.
