Milbank Attorneys Author Chapter on ESG Considerations in ICLG: Environmental, Social & Governance Law 2024

Milbank LLP Environmental partner Matt Ahrens, Global Project, Energy & Infrastructure Finance partner Allan Marks, Global Corporate/M&A partner Iliana Ongun and Environmental associate Allison Sloto co-authored a chapter titled “ESG Considerations in Project, Energy, and Infrastructure Finance” in the International Comparative Legal Guide - Environmental, Social, & Governance Law 2024. Global Corporate/M&A partner Neil Whoriskey and Environmental special counsel Thomas Goslin also contributed.

The chapter discusses how environmental, social, and governance (“ESG”) considerations, which have long been important for understanding risk in project finance transactions, now present new dimensions of investment, credit and reputational risk. At the same time, the chapter explains, how investors and shareholders are searching for greater ESG accountability and transparency and pushing for better reporting to assess the impact of their investments. The chapter also discusses instruments for ESG investment, such as green, social, and sustainability bonds, as well as topical frameworks for companies to utilize to achieve ESG goals and when reporting on ESG metrics.
