Milbank LLP Litigation & Arbitration partner Julian Stait chaired a panel session at the Legal Business Financial Regulatory and Disputes Summit 2022 in London on November 14, 2022.
The subject matter of the session was “Emerging trends in collective redress in financial services disputes.” The panel concluded that we are living through a key phase in the evolution of the various mechanisms for collective redress in the UK, following a number of important recent judgments. The discussion covered emerging trends, particularly in class actions and the innovative ways in which certain courts are approaching the joint case management of individual claims, and how this might have an impact on financial services disputes. The panel also considered the extent to which we are moving towards a US-style class action model, and assessed whether a desire for access to justice might give rise to a risk of injustice.
