ITC Recommends Tariffs in Suniva Trade Case: Potential Consequences for American Solar Industry

Milbank Project, Energy and Infrastructure Finance partner Allan Marks penned an article published by Forbes on the United States International Trade Commission’s (ITC) highly anticipated recommendations on solar power tariffs in response to a Section 201 trade case brought by Suniva Inc. and SolarWorld Americas, Inc. The case seeks trade protection against imports of crystalline silicon photovoltaic (“CSPV”) – including solar panels, cells and modules – from certain foreign countries by imposing tariffs on imported solar equipment.

On October 31, 2017, the ITC issued recommendations, which, if adopted by the President, would ultimately increase the cost of installing new solar power facilities in the United States. In the article, Marks discusses the impact of the higher costs on the $23 billion US solar power industry.
