Gregory D. Jones

Primary Focus & Experience

Mr. Jones is an experienced energy attorney with broad experience across the U.S. power sector, regularly advising on regulatory, transactional and litigation matters. Mr. Jones represents a diverse array of clients, including renewable energy developers, battery storage operators, power marketers, lenders and investors in traditional and renewable generation, and electric utilities, including non-jurisdictional entities such as rural electric cooperatives. His ubiquitous approach to energy law results in a diverse practice, from contract negotiations and regulatory due diligence, to administrative litigation and settlement proceedings, to routine (and non-routine) filings and compliance work before the Federal Energy Regulatory Commission (FERC), state public utility commissions, and other federal and state agencies.

Mr. Jones works extensively on data center and renewable energy matters, finding creative solutions to complex issues involving generator interconnections, microgrids, distributed generation and community solar, and demand response. He also monitors and tracks developments in wholesale energy and capacity markets across the country and works extensively on traditional ratemaking matters, including stated and formula rates, open access transmission tariffs, applications under FERC’s merger and acquisition authority, and PURPA and PUHCA issues.

His recent experience includes the representation of: 

• LS Power as FERC counsel in connection with the sale of 13 GW of natural gas-fired generating facilities to NRG Energy for approximately $13 billion in cash and NRG stock.*
• Olympus Power as FERC counsel in connection with a restructuring and recapitalization of the Cricket Valley Energy Center, an approximately 1.2 GW natural gas generation facility in New York.*
• Caithness Energy as FERC counsel in connection with the sale of the 1,875 MW Guernsey Power Station and the 1,105 MW Moxie Freedom Energy Center to Talen Energy for approximately $3.5 billion, and the sale of the 365 MW Caithness Long Island facility to Lotus Infrastructure Partners.*
• Rappahannock Electric Cooperative and Hyperscale Energy Services in various regulatory and transactional matters to support their efforts to interconnect several large data center campuses in their service territory.*
• LS Power as FERC counsel in connection with the acquisition of a 23 GW portfolio of renewable energy and energy storage facilities from Algonquin Power & Utilities for $2.5 billion.*
• A rural electric cooperative on regulatory and transactional issues arising from the proposed interconnection of a large data center load, including drafting power supply and other key agreements.*
• Negotiated a power purchase agreement for a microgrid project to power a 100% carbon-free resort community.*
• RWE Clean Energy in a settlement proceeding involving an unexecuted interconnection service agreement with PJM Interconnection, L.L.C. and Commonwealth Edison Company for a planned 116 MW solar facility.*
• United Power, Inc. in multiple FERC proceedings, including a fully litigated, multi-billion dollar exit fee proceeding, securing United Power’s withdrawal from membership in Tri-State Generation & Transmission Association, Inc.*
• Citizens Electric Corporation in formula rate template proceeding at FERC involving its all-requirements supplier Wabash Valley Power Association, advising on complex rate design issues.*
• A coalition of renewable energy developers in opposing PJM’s generator interconnection queue reform filing and in supporting FERC’s proposed rule to reform interconnection queues that led to the landmark Order No. 2023.*
• GlidePath Power Solutions on federal and state regulatory issues involving the sale of several renewable energy generating facilities.*
• LS Power on regulatory issues and filings in its acquisition of over 40 hydro facilities totaling over 300 MWs from Hull Street Energy.*
