Milbank Partner Josh Sterling Speaks at PLI's Storming the Gatekeepers 2026

Josh Sterling, a Litigation & Arbitration partner at Milbank LLP and former Director of the CFTC's Market Participants Division, will take part on the panel "Trends in SEC, Department of Justice and CFTC Enforcement Actions Against Gatekeepers" at Practising Law Institute's (PLI) Storming the Gatekeepers: When Compliance Officers and In-House Lawyers Are at Risk event on July 15 in New York City.

Mr. Sterling brings a unique perspective to the panel's discussion of recent trends and enforcement activity involving individual liability for gatekeepers, drawing on his experience both as a senior federal regulator and as a litigator representing companies and individuals in high-stakes investigations and enforcement proceedings before the CFTC, the SEC and self-regulatory organizations.

As Director of the CFTC's Market Participants Division, Mr. Sterling oversaw the 3,300-plus banks, intermediaries and asset managers registered with the agency to trade derivatives in US markets and was responsible for the CFTC's examination, rulemaking and enforcement referral programs governing those firms. He also played an instrumental role in completing the remaining rulemakings required by the Dodd-Frank Act and in charging and settling several groundbreaking enforcement actions.

At Milbank, Mr. Sterling currently leads the firm's nationwide litigation efforts concerning the legality of event contracts and prediction markets and advises early-stage and established companies on developing novel financial products, including perpetual futures and security futures.
