Milbank LLP Litigation & Arbitration partner Josh Sterling will speak at the National Council of Legislators from Gaming States (NCLGS) Summer Meeting, taking place July 9-12, 2025, in Louisville, Kentucky.
Mr. Sterling will present with the Committee on Emerging Forms of Gaming, where he will participate on a panel discussing ongoing disputes over whether derivatives markets are properly regulated by the CFTC or the states. Topics will include current challenges to the federal preemption of state gaming laws as applied to CFTC-licensed markets for event contracts, perpetual futures and other innovative derivatives.
As former Director of the CFTC's Market Participants Division, Mr. Sterling is widely respected by our clients for his practical advice on a range of strategic regulatory, transactional, and enforcement matters involving commodities and derivatives. He has extensive experience in registering trading platforms, dealers and asset managers with the CFTC, and in assisting those clients with developing systems for trading innovative derivatives products. He is also actively involved in several pivotal lawsuits in federal and state courts that get to the very nature of how these markets are evolving.
The National Council of Legislators from Gaming States (NCLGS) is the only organization of state lawmakers that meets on a regular basis to discuss issues in regard to gaming.
