Milbank Partner John Beahn Joins ABA Panel on National Security Reviews of Transactions by State-Affiliated Investors

Milbank LLP Global Risk & National Security partner John Beahn joined an American Bar Association (ABA) panel, “FDI Spotlight: State-Owned Enterprises,” on March 12, 2024, that reviewed the implications of foreign direct investment transactions undertaken by state-affiliated investors. Sovereign wealth funds and other state-owned enterprises are a large source of capital for the US and global economy, and those investors must navigate increasingly complex national security regimes in the US and abroad.

Mr. Beahn along with the other panelists examined how CFIUS and other foreign direct investment authorities assess the risks associated with state-owned enterprise transactions in light of ongoing geopolitical developments and tensions. Mr. Beahn and the other panelists also reviewed the current landscape of national security reviews for these transactions and provided insights into current trends. 

Mr. Beahn, a partner in the Washington, DC office of Milbank, focuses his practice on matters related to foreign direct investment issues, particularly the Committee on Foreign Investment in the United States. Mr. Beahn has successfully represented domestic and foreign clients, including purchasers, sellers, investors, private equity sponsors and consortia and other institutional and state-affiliated investors in transactions and investments subject to CFIUS and other national security reviews.
