John C. Garces

Primary Focus & Experience

Mr. Garces has a broad and diverse practice  representing and counseling clients on technology and commercial issues related to IP, data, technology, privacy and cybersecurity.  His practice includes advising on intellectual property, data and technology aspects of private equity, mergers and acquisitions, financings, licensing, outsourcing and other commercial transactions.  In addition to commerical and transactional matters, Mr. Garces has extensive experience litigating all phases of patent and other intellectual property cases before US district courts and the International Trade Commission.

His representative matters include:

• Counseled and advised client in mortgage industry regarding competitors' patents in the areas of electronic mortgage origination, online electronic document management, electronic signatures and electronic notarization.
• Negotiated favorable license agreement on behalf of license in settlement of a patent dispute.
• Drafted and prosecuted various Internet and software patents involving data mining, mortgage risk assessment and collaborative electronic documents.
• Drafted motion papers and briefs and conducted discovery in litigation involving data compression technology.
• Prosecute patents and aggressively enforce rights to computer software and business methods, as well as electrical and mechanical inventions.
• Represent and counsel clients in business transactions regarding intellectual property assets including licensing of patent rights, trade secrets, trademarks and purchase/merger/investment matters concerning technology companies.
• Prepare pleadings, motions and discovery requests and responses; analyze prior art in connection with litigations and validity opinions; and prepare invalidity and non-infringement opinions.

Mr. Garces earned his J.D. from Brooklyn Law School and his B.E. from Manhattan College.
