Milbank LLP special counsel Mark Padley spoke on the topic of "Competition Litigation: Has it Peaked or Is It Just Getting Started?" at CompLaw: Future Leaders, held in Amsterdam on June 24.
The discussion covered private versus public enforcement, the effectiveness of collective proceedings and class action regimes, and whether the concept of "abuse" of dominance is being stretched too far. The session also examined approaches to economic evidence and damages, the evolving appetite of litigation funders, and lessons learned from recent cases.
The conference, which focuses on the next generation of competition law practitioners, brought together private practitioners, in-house counsel, economists and representatives from regulatory bodies.
