Connolly: The Consequences of Outsourcing Government Investigations to the Private Sector.” The article analyzes the recent decision by the Chief Judge of the Southern District of New York holding that the Department of Justice improperly outsourced its investigation of LIBOR manipulation at Deutsche Bank (“the Bank”) to the Bank and its outside law firm. The authors discuss how the court’s sharp rebuke of the government could result in meaningful changes to the way that prosecutors and defense attorneys approach internal investigations.
