Josh Sterling, Litigation & Arbitration partner at Milbank LLP and former Director of the CFTC's Market Participants Division, will speak on a panel titled “The Jurisdiction Gap: One Ruling, Two Very Different Markets” at the NEXTPredict 2026 Conference on October 23, 2026, in New York.

The panel will discuss the developing circuit split over prediction market regulation: the Third Circuit has held that event contracts are swaps subject to exclusive CFTC oversight, while weeks later, the Ninth Circuit held that sports event contracts are not swaps, allowing states such as Nevada to enforce their own gaming laws. With the question now on the Supreme Court’s doorstep two weeks before the midterms, the session will explore what each outcome means for national market access, product expansion and sports contracts, as well as how operators, exchanges and investors should prepare.

Mr. Sterling joins a distinguished panel moderated by Elliott Stein, Litigation Analyst at Bloomberg Intelligence. The other panelists include Jovy Dedaj, Head of Litigation at Kalshi; Brigitte Weyls, General Counsel at Gemini Titan; and Bill Pascrell III, Partner at Princeton Public Affairs Group, Inc.
