Milbank Litigation Partners Selected for Law360’s 2018 Editorial Advisory Boards

Litigation & Arbitration partners David Cohen and Atara Miller have been chosen to serve on Law360’s editorial advisory boards for 2018. David Cohen has been selected to serve on the Bankruptcy Editorial Advisory Board. Atara Miller has been selected for a second consecutive year to serve on the Media and Entertainment Editorial Advisory Board. Their board service will include sharing insights on emerging topics for future coverage and providing feedback on the publication throughout 2018.

Mr. Cohen is a partner in the Washington, DC office of Milbank, Tweed, Hadley & McCloy. He has a broad litigation practice, with special emphasis on bankruptcy. His ongoing and recent representations include: the Official Committee of Unsecured Creditors of the US subsidiaries of Takata Corporation in their chapter 11 proceedings following the largest automotive recall in US history; an ad hoc group of lenders in defending an adversary proceeding initiated in connection with the chapter 11 cases of retailer American Apparel; the Official Committee of Unsecured Creditors in the chapter 11 cases of Alpha Natural Resources, one of the largest producers of coal by volume in the United States; an ad hoc group of first lien lenders in connection with the chapter 11 cases of SH 130 Concession Company, LLC, which held debt in the amount of approximately $1.3 billion; and an ad hoc group of unsecured creditors in the chapter 11 cases of Linn Energy, LLC, a Houston-based oil and gas producer that held approximately $8.3 billion in debt.

Ms. Miller is a partner in the New York office of Milbank, Tweed, Hadley & McCloy. Her practice focuses on federal and state court litigation of complex commercial matters and music rights licensing. She litigates and negotiates appropriate rates for music performing rights, on behalf of Broadcast Music, Inc. (BMI), including cases against ESPN and the radio industry. She obtained a trial victory for BMI against Pandora Media, Inc. The decision was identified by Law360 as one of the biggest copyright rulings of the year, and is changing the market for performing rights in the digital era. Most recently, Ms. Miller successfully challenged the Department of Justice’s interpretation of BMI’s antitrust Consent Decree, which was affirmed on appeal. She was identified as Litigator of the Week by the American Lawyer for the victory. In 2016, Ms. Miller was recognized as “one of the top media and entertainment attorneys under the age of 40” by Law360 as part of its annual “Rising Stars” series.
