Michael L. Hirschfeld is a partner in the Litigation Department of Milbank, Tweed, Hadley & McCloy LLP, resident in the firm’s New York office.  His practice focuses on federal and state court litigation of complex commercial matters and class actions involving securities and corporate law, mergers and acquisitions, and international arbitration, primarily with respect to natural gas.  Mr. Hirschfeld also has extensive experience counseling participants in international transactions and financings on litigation risks and strategies.  On behalf of firm client Liggett Group Inc., he was instrumental in negotiating the first groundbreaking tobacco product liability settlement with state Attorneys General in 1996 that formed the template for the subsequent industry-wide settlement. 

Matters concluded successfully in 2007 include:

  • the representation of private equity firm Cerberus Capital Management and affiliates in connection with their termination of a planned acquisition of United Rentals, Inc.,

  • the defense of mutual fund Neuberger Berman Real Estate Income Fund, Inc. against a hostile takeover, and

  • the defense of the merger of The IntercontinentalExchange, Inc. and commodities exchange Board of Trade of the City of New York against a challenge by NYBOT floor brokers.

Since early 2001, Mr. Hirschfeld has counseled Atlantic LNG Company of Trinidad and Tobago and certain of its stockholders and affiliates with respect to contract price reopener matters and has led the team of Milbank attorneys currently engaged on behalf of Atlantic LNG and affiliates in a number of UNCITRAL arbitrations relating to liquefied natural gas pricing disputes. 

Mr. Hirschfeld received his B.A. from Brown University cum laude and his J.D. from New York University School of Law.
