Jasper L. Tran is an associate in the Los Angeles office of Milbank LLP and a member of the firm’s Litigation & Arbitration Group, with a focus on intellectual property.
Primary Focus & Experience
Mr. Tran’s practice focuses on complex patent and trade secret litigation in federal courts. As a technical generalist, he has litigated competitor patent, copyright, trade secret, and antitrust cases involving emerging technologies ranging from mobile electronics and computer software to medical devices and pharmaceuticals. He is experienced in all phases of litigation through trial and appeal. Additionally, he has drafted agreements and conducted due diligence related to the acquisition, divestment, and licensing of intellectual property assets.

Teradata v. SAP (N.D. Cal.). Defended Enterprise Resource Planning (ERP) company in competitor multi-patent, copyright, trade secret, and antitrust litigation involving SAP’s flagship product, HANA.
Synopsys v. Mentor Graphics (N.D. Cal.). Represented Electronic Design Automation (EDA) company in competitor multi-patent litigation.
Godo Kaisha IP Bridge 1 v. Xilinx (E.D. Tex. & N.D. Cal.). Defended Field-Programmable Gate Array (FGPA) company in multi-patent litigation with Japanese sovereign patent fund.
SAP’s $8-billion acquisition of Qualtrics. Conducted buy-side due diligence on IP and IT agreements.
NVIDIA’s $7-billion acquisition of Mellanox. Conducted buy-side due diligence on IP and IT agreements, including FRAND agreements.
Lumentum’s $1.8-billion acquisition of Oclaro. Conducted sell-side due diligence on IP and IT agreements.
Recognition & Accomplishments
Mr. Tran has written for the Indiana Law Journal; George Washington, Iowa, and Vanderbilt Law Reviews; Harvard and Yale Journals of Law and Technology; and IEEE Annals, among others. He serves on the editorial board of the PTAB Bar Association Law Journal.
Mr. Tran was previously a Google Policy Fellow and a Humphrey Policy Fellow.
Prior to his legal career, Mr. Tran researched nanostructures for organic solar cells at the Lawrence Berkeley National Laboratory.
Mr. Tran is fluent in Vietnamese.
