Eric Hyla is an associate in the New York office of Milbank LLP and a member of the firm’s Litigation & Arbitration Group, with a focus on antitrust and intellectual property.
Primary Focus & Experience
Mr. Hyla’s practice focuses on antitrust and intellectual property litigation. He is especially interested in the intersection of intellectual property and antitrust laws and has helped advise clients regarding F/RAND commitments for standard essential patents and potential antitrust concerns regarding pharmaceutical “pay for delay” settlements and patent thickets.
Select experience includes:
- Boards & More Inc. v. North Sails Group, LLC. Secured an important victory obtaining judgment on the pleadings on behalf of Boards & More Inc. against North Sails Group, LLC in a trademark infringement case filed in the US District Court for the Eastern District of Washington relating to the launch of B&M’s Duotone kiteboarding and windsurfing equipment.
Recognition & Accomplishments
Mr. Hyla serves as the Young Lawyer Representative to the IP Committee of the Antitrust Section of the ABA and as an editor of the Committee’s weekly tidBITS newsletter. He is the author of Corporate Cybersecurity: The International Threat to Private Networks and How Regulations Can Mitigate It, 21 Vand. J. Ent. & Tech. 309 (2018).
Mr. Hyla received his J.D. from Vanderbilt Law School, where he represented clients in copyright registration and disputes in Vanderbilt’s Intellectual Property and the Arts clinic. He received his B.A. in Economics from Illinois Wesleyan University.
