Milbank's Environmental Practice Group performs specialized environmental services in connection with the Firm's transactional and litigation practices. Areas of specialty include:
Regulatory Counseling
Counsel international industrial and energy companies, real estate developers, lenders, investors and buyers regarding complex environmental and natural resource regulatory compliance and permitting strategies, such as advising electricity generation companies on environmental permitting, emissions trading and Clean Air Act regulatory changes, and advising lenders and investors about the business implications of proposed and pending environmental legislation and regulations.
Corporate Transactions
Support Milbank’s corporate practice during acquisitions, mergers, divestitures and private equity investments through contract negotiation and environmental risk assessment, including evaluation of risks associated with contaminated real property, non-compliance with environmental, health and safety laws, off-site waste disposal or “Superfund” liability, environmental “legacy” liabilities from historic facilities and operations, and environmental litigation, including asbestos, silicosis and other exposure and environmental damage claims.
Workout and Restructuring
Advise creditors, debtors and asset purchasers in workout and restructuring proceedings on strategies for addressing environmental risk and contaminated real properties and protecting reorganized entities from historic environmental liabilities.
Financial Transactions
Support Milbank’s financing practice through contract negotiation and due diligence, including international projects involving compliance with domestic, foreign and international environmental requirements, and with the environmental guidelines and procedures of the World Bank Group, other development banks and export credit agencies.
Environmental and Renewable Energy Projects
Negotiate and close financing for environmental projects, such as waste management facilities, water and wastewater treatment facilities and privatizations, and pollution control and environmental technology companies, and renewable energy projects, such as wind energy, biomass, and landfill gas projects, including the evaluation and transfer of renewable energy credits.
Litigation
Pursue and defend environmental claims relating to site contamination and regulatory enforcement, including advising investors, lenders and financial parties regarding the significance of such claims to business plans.
