Legislative and Regulatory Capabilities

  • advising clients on the effects of the five principal international space treaties.

  • advising clients on the impact of U.S. bilateral agreements on international trade in commercial space launch services.

  • assisting clients with the regulations administered by the Federal Aviation Administration governing commercial space launch services and launch site operations.

  • advising clients on the various effects of the Communications Act of 1934 (as amended by the Telecommunications Act of 1996) on their communications projects, such as the effect of the FCC’s foreign ownership restrictions.

  • advising clients on how to comply with FCC regulations that affect satellite projects, such as the preparation and submission of license applications under Part 25 of the FCC rules.

  • advising clients on developments at the World Trade Organization that may affect satellite services and impact related FCC and ITU regulations or policies.

  • in connection with our support of clients seeking licenses from the FCC, we assist in the preparation of information required by the ITU for Advance Publication and Coordination, including Appendix 4 and Appendix S4 (formerly referred to as Appendix 3) data.

  • assisting clients with formulating responses to requests from national administrations for orbital slot and frequency coordination.

  • in connection with the structuring of satellite financings, performing due diligence on the status at the ITU of the satellite system that is the subject of the financings.

  • advising clients on the results and proposals arising out of the ITU’s World Radiocommunication Conferences, including efforts to resolve the “paper” satellite situation.

  • advising clients on the scope, interpretation and operation of the ITU Convention and Radio Regulations, including dispute resolution mechanisms.

  • with respect to Direct Broadcast Satellites, we assist clients not only on FCC licensing and policy issues, but also on issues arising under the Satellite Home Viewer Improvement Act and legislation affecting local broadcasting in rural areas.

  • assisting clients with the licensing process for private, commercial remote-sensing satellite systems administered by the Department of Commerce’s National Oceanic and Atmospheric Administration.

  • advising clients on compliance with U.S. export control regulations administered by the Departments of Commerce and State, including helping clients establish comprehensive internal trade compliance programs.

  • supporting clients in their interaction with Members of Congress and Staff on legislation affecting their business.
