Milbank Elects Five Attorneys to Partnership
NEW YORK, November 23, 2009 – International law firm Milbank, Tweed, Hadley & McCloy LLP has announced the election of five new partners to the Firm’s New York, Munich and Tokyo offices. The new partners are: Evan Fleck, Thomas Kleinheisterkamp, Robert J. Liubicic, Tyson M. Lomazow and Mark Plenderleith.
NEW YORK:
EVAN FLECK, formerly an associate, has been named a partner in Milbank’s Financial Restructuring Group. He has worked on a wide range of corporate restructurings and bankruptcies, representing debtors, creditors, lenders and other strategic parties. Mr. Fleck currently serves as one of the lead lawyers in Milbank's representation of Lehman's Official Committee of Unsecured Creditors. His noteworthy prior representations include Northwest Airlines and Enron Corp. in their respective chapter 11 cases, ad hoc groups of Quebecor and Calpine noteholders, and the Official Committee of Unsecured Creditors of Heartland Automotive. He has advised numerous other creditors in distressed situations, including high stakes avoidance actions, and he also has extensive experience advising on the bankruptcy aspects of complex derivative and structured financing transactions.
Mr. Fleck received his J.D., cum laude, from Georgetown University Law Center and his undergraduate degree, cum laude, from the University of Pennsylvania. He is admitted to practice in the State of New York and in the U.S. District Court for the Southern District of New York.
ROBERT J. LIUBICIC, formerly an associate, has been named a partner in Milbank’s Litigation Department. Mr. Liubicic's practice includes a broad range of complex commercial litigation and domestic and international arbitration, with an emphasis on securities and M&A-related matters. He has represented a variety of financial institutions including investment banks, mutual fund advisors, hedge and private equity funds, and broker-dealers as well as corporations in industries including energy, chemicals, telecommunications, insurance, retailing and pharmaceuticals. Mr. Liubicic was a member of the trial team in United Rentals, Inc. v. RAM Holdings, Inc., in which Milbank successfully defended an attempt to compel affiliates of Cerberus Capital Management to close on a multi-billion dollar merger, and he has litigated a number of similar, often expedited disputes.
Mr. Liubicic received his J.D. from Columbia Law School, where he was a James Kent Scholar and a recipient of the Whitney North Seymour Medal for Trial Practice. He received his B.S. from Cornell University. Following law school, Mr. Liubicic served as a law clerk to the Hon. Wilfred Feinberg and the Hon. Robert A. Katzmann of the United States Court of Appeals for the Second Circuit.
TYSON M. LOMAZOW, formerly an associate, has been named a partner in Milbank’s Financial Restructuring Group. Mr. Lomazow has extensive experience in representing debtors and creditors in chapter 11 reorganization cases and out-of-court restructurings. Mr. Lomazow’s experience also includes representing acquirors and sellers of assets of chapter 11 debtors and financially distressed companies, negotiating debtor-in-possession financing facilities, and drafting reorganization plans and disclosure statements. His engagements have ranged across a wide array of industries, including automotive, construction, healthcare, manufacturing, printing, real estate, restaurant, satellite, subprime lending, technology, telecommunications and textile.
Mr. Lomazow’s recent representations include the DIP agents in the chapter 11 cases of Hayes-Lemmerz International, Inc., and Cooper-Standard Automotive, Inc.; the ad hoc group of unsecured banks in the chapter 11 cases of Capmark Financial Group, Inc.; the official committee of unsecured creditors of VICORP Restaurants, Inc.; the indenture trustees with respect to General Motors Corporation’s 2001A and 2000A leveraged lease financings; and the acquiror of the assets of USA Commercial Mortgage Company.
Mr. Lomazow received his J.D. from Georgetown University Law Center and his undergraduate degree from Emory University.
MUNICH:
THOMAS KLEINHEISTERKAMP, formerly an associate, has been named a partner in Milbank’s Tax Department. His practice areas comprise all aspects of national and international tax law and related corporate law aspects. In particular, Mr. Kleinheisterkamp specializes in transactional tax advice and corporate tax law including the tax aspects of corporate reorganizations. He also advises both lenders and borrowers in all tax-related areas of acquisition and corporate finance and financial institutions on tax aspects relating to a broad range of financial products like warrants and certificates.
Mr. Kleinheisterkamp studied law and economics at the University of Bayreuth, Germany, where he also obtained a doctorate degree (Dr. jur.). Before joining Milbank, he was a tax associate at a major international law firm in Munich. Mr. Kleinheisterkamp is admitted to the German bar and is accredited as tax advisor and certified tax lawyer (Steuerberater, Fachanwalt für Steuerrecht) in Germany.
TOKYO:
MARK PLENDERLEITH, formerly an associate, has been named a partner in Milbank’s Global Project Finance Group. He specializes in multi-source limited recourse financing, reserve-based lending, international joint ventures and leveraged finance. He is a dual-qualified lawyer advising clients in respect of both New York law and English law transactions. His practice focuses on energy (including nuclear power and renewable energy), mining and infrastructure. Mr. Plenderleith previously worked for the Japan Bank for International Cooperation (JBIC) as a member of the project finance department. Mr. Plenderleith’s representations include JBIC and the commercial lenders in connection with the award-winning financing of Sumitomo Corporation's coal-fired Tanjung Jati B Expansion Project in central Indonesia; JBIC in connection with its first borrowing-base transaction in North America; and Olympus Capital Holdings Asia in a share collateral-backed recapitalization and the subsequent acquisition financing in connection with its acquisition of Arysta LifeScience Corporation. He is a graduate of Pembroke College, Oxford University.
