Sean M. Murphy Recognized as One of the Elite Top 50 Young Litigators in the Nation
NEW YORK, January 2, 2007 – The American Lawyer has designated Sean M. Murphy, a partner at the international law firm Milbank, Tweed, Hadley & McCloy LLP, as a Fab Fifty Young Litigator, an elite group of litigators whom the The American Lawyer recognizes as the top fifty litigators in the United States under age 45. Mr. Murphy, age 37, is a securities litigator in the New York office of Milbank.
Mr. Murphy represents major mutual fund and financial service companies, including AllianceBernstein, Fidelity, Capital Research & Management Company, American Century Companies, and Citigroup. Co-led, with Jim Benedict, the defense of American Century Investment Management, Inc. in one of the largest mutual fund excessive fee securities actions ever filed (Baker v. American Century Investment Management, Inc.) The plaintiffs voluntarily dropped their billion dollar case on the eve of the trial.

In one of the top defense wins of 2005, Mr. Murphy was one of the lead defense attorneys representing Alliance Capital in a state court action brought by the Florida State Board of Administration, the third largest public pension fund in the United States, seeking over $3 billion in damages. After a seven week jury trial, the jury dismissed all of the claims against Alliance Capital and awarded Alliance $1.2 million in unpaid advisory fees.
Focusing on complex securities and antitrust matters, Mr. Murphy defends companies in high-stakes class action and derivative litigation, often involving regulatory investigations by federal or state agencies.
In antitrust matters, he has defended major cases involving conspiracy and monopolization allegations, illegal exchanges of information, deal structuring and vertical relationships. He has represented clients such as DuPont, Hearst Corporation, Nine West, Shell Oil and Tyco International, on antitrust matters.
In addition to being named a leading securities lawyer by The American Lawyer, Mr. Murphy has been recognized as a leading securities litigator by Chambers USA and was recently selected as one of Lawdragon’s “500 New Stars.”
