Thomas A. Arena is a member of the Firm’s Litigation Department and Risk Management Committee.

Mr. Arena’s practice principally focuses on the representation of institutions and individuals in federal and state courts in complex securities matters. Mr. Arena has defended companies, directors, and officers on a wide range of issues under the federal securities laws, including claims under the Securities Act of 1933 and the Securities Exchange Act of 1934. He also has extensive experience representing mutual fund advisers in derivative litigation filed under the Investment Company Act of 1940.

In addition, Mr. Arena has substantial commercial litigation experience, and has defended public and private companies in complex litigations involving ERISA, state and federal environmental law, federal bankruptcy law, insurance and reinsurance contracts, and mergers and acquisitions.

Prior to joining Milbank in 1998, Mr. Arena was an Assistant United States Attorney for the Southern District of New York, where he participated in a wide variety of investigations and successful prosecutions of criminal violations involving racketeering, tax fraud, computer fraud, bank fraud and money laundering. In both 1996 and 1998, Mr. Arena received the Director’s Award for Superior Performance from the Executive Office of United States Attorneys in Washington, D.C.

In 1989 Mr. Arena received a J.D. from Yale Law School, where he was an Articles Editor of the Yale Law Journal. In 1986 he received an A.B., summa cum laude, from Princeton University, and was a member of Phi Beta Kappa. He clerked for the Honorable Jon O. Newman of the United States Court of Appeals for the Second Circuit.

Mr. Arena is a member of the Committee on Professional and Judicial Ethics, Association of the Bar of the City of New York. He is admitted to practice in the State of New York.
