Linda Dakin-Grimm is a partner in the Los Angeles and the New York offices of Milbank, Tweed, Hadley & McCloy LLP. She received a B.A. cum laude from Yale University and a J.D. from Harvard Law School.

Primary Focus & Experience

Her practice includes a variety of complex business litigation matters, including reinsurance and insurance disputes, on behalf of major property/casualty and life insurers and reinsurers. Ms. Dakin-Grimm has successfully handled numerous trials, appeals, mediations and arbitration proceedings across the US.

In 2010, Ms. Dakin-Grimm won in trial, on behalf of a group of secured lenders, in a hotly contested  “cram-up” fight in the US Bankruptcy Court in the Southern District of New York, defeating both the Debtor and the Creditors’ Committee’s efforts to reinstate secured debt of Young Broadcasting. The court’s 60 page decision was reported at 430 B.R. 99 (Bankr. SDNY 2010). In 2007, she won a five-week jury trial in the US District Court for the Central District of California, concerning the breach of a stock purchase agreement. In 2006, Ms. Dakin-Grimm prevailed in a two-month trial in the US Bankruptcy Court in Delaware, on behalf of a consortium of banks who disputed the enterprise value of a Debtor. That case was reported at 356 B.R. 364 (Bankr. D. Del 2006). She represented eight US insurers and their European parents in a well-publicized dispute with the California Department of Insurance, over the Department’s purported regulation of European life insurers. The US Supreme Court ruled in favor of Ms. Dakin-Grimm’s clients. Ms. Dakin-Grimm repeatedly has won victories for property/casualty insurers and reinsurers in confidential arbitration disputes. She obtained full rescission of a reinsurance treaty in arbitration on behalf of several major reinsurers in a fraud dispute with their cedents.

Ms. Dakin-Grimm has published articles in publications including: the National Law Journal, National Underwriter, Best’s Review, Business Insurance, Reinsurance, The Deal, Directors Monthly, The Lawyer, Mealeys Reinsurance, Verdicts & Settlements, California Litigation, California Management Review, Corporate Conduct Quarterly, California Law Business. She authored a chapter on corporate criminal liability in the treatise “Compliance Programs and the Corporate Sentencing Guidelines,” published by West Group (New York).

Ms. Dakin-Grimm is a frequent speaker at conferences and seminars. She co-chaired the 2010 ARIAS Spring Meeting, and has spoken frequently at the ARIAS Annual Meetings since 2003. Ms. Dakin-Grimm has consistently been ranked as a leading lawyer in various publications, including Chambers USA, The International Who's Who of Business Lawyers  and The Best Lawyers in America.
