Jay Alexander is Of Counsel in Milbank’s Washington, DC office, where he is a member of the firm’s Litigation department.

Primary Focus & Experience

Mr. Alexander has more than twenty years of experience in patent and other complex Intellectual Property litigation including trademarks, trade secrets, unfair competition and copyright issues. He has represented clients in the United States District Courts, the US International Trade Commission, the US  Court of Appeals for the Federal Circuit and the US Supreme Court.

His recent representations include patent litigation matters involving:

  • A major multinational manufacturer of chemical pesticides
  • A major Asian supplier of semiconductor circuit devices
  • A leading international pharmaceutical company
  • The leading supplier of wood preservative chemicals in the United States
  • The leading supplier of genetically engineering enzyme technology in the world
  • The leading innovator in the use of DNA array technology
  • A leading juvenile products manufacturer

Previous cases have involved major litigation and appellate matters involving pharmaceuticals, biotechnology, computer software, communications networks, satellite technology, digital cellular telephony and semiconductors.

Recognition & Accomplishments

Mr. Alexander has authored various articles and papers on patent law subjects and has spoken at numerous conferences on these topics.  For example, his 2003 article regarding the patent law doctrine of equivalents was reprinted in the Intellectual Property Law Review as one of the leading patent law review articles of that year.

Prior to joining Milbank in August 2002, Mr. Alexander was a senior counsel at Fulbright & Jaworski, and was a partner at Kirkland & Ellis. From 1990 to 1992, he served as a law clerk to the Honorable Pauline Newman, Circuit Judge of the US Court of Appeals for the Federal Circuit, and previously was a patent examiner in the US Patent & Trademark Office.

Mr. Alexander is admitted to practice before the United States Supreme Court, the US Court of Appeals for the Federal Circuit, and various US District Courts. He also is admitted to practice in the District of Columbia and is registered to practice before the United States Patent & Trademark Office.

Mr. Alexander received his Juris Doctor, cum laude, in 1990 from the Northwestern University School of Law where he was awarded the Order of the Coif. He received his Bachelor of Science degree in Mechanical Engineering from Northwestern University in 1985.
