David Isenberg has been of counsel in the Global Corporate Department of Milbank, Tweed, Hadley & McCloy LLP since 2005.
Primary Focus & Experience
Mr. Isenberg specializes in the structuring, documentation and resolution of secured transactions, including secured lending transactions and secured debt issuances, in each case with respect to both issuers and investors, and with respect to both senior and junior secured positions in the capital structure.
His recent representations include advising issuers and investors on:
- the bankruptcy court and out of court restructurings of single asset and multiple property gaming companies
- out of court restructurings of secured credits to industrial companies, including metals recycling companies and agribusinesses
- out of court restructuring of secured credits to off shore resort condominium developers
- state court liquidations of real property collateral owned by a multistate merchant homebuilder
- out of court restructuring of a securitized receivables facility
Recognitions & Accomplishments
Mr. Isenberg speaks and writes frequently on issues related to intercreditor arrangements and resolution of distressed debt. Mr. Isenberg is the co-author with Gregory A. Bray of “Distressed Debt Investing – Risk Considerations” in The Handbook of Loan Syndications and Trading, Allison Taylor and Alicia Sansone (McGraw Hill 2007) and the author of “Toward a Compromise on Collateralizing Loans to Broadcasters” in 45 Federal Communications Law Journal 541 (1993). Mr. Isenberg is also a regular contributor to The Journal of Corporate Renewal, where articles are “Risk Considerations When Investing in Distressed Debt” (Vol. 19 No. 12, December 2006) and “’Silent Firsts Offer Alternative to Typical Intercreditor Terms” (Vol. 19 No. 6, June 2006). Mr. Isenberg is a member of the American Bankruptcy Institute and the Commercial Bankruptcy Committee of the American Bar Association.
